1. No Refunds or Exchanges
All sales are final. We do not offer refunds, exchanges, or rain checks for any reason
including but not limited to changes in personal circumstances, weather conditions, or
event modifications. Before you purchase tickets, please carefully review your event and
seat selection.
2. Lost or Stolen Tickets
BD Performing Arts is not responsible for lost, stolen, or damaged tickets. It is the purchaser’s responsibility
to keep their tickets safe. Replacement tickets will not be issued.
3. Non-Transferable
Tickets and audition passes are non-transferable and may not be resold or exchanged. Any attempt to resell or
transfer tickets will result in invalidation without refund or compensation.
4. No Cash Redemption
Tickets and audition passes are not redeemable for cash and have no cash value. They are valid only for the
specific event or audition for which they were purchased.
5. Event Changes and Cancellations
BD Performing Arts reserves the right to change the event program, date, time, and venue without notice. In the
unlikely event of a cancellation, tickets and audition passes may be refunded at the discretion of BD Performing
Arts.
6. Admission Rights
Admission to events and auditions is subject to the rules and regulations of the venue and BD Performing Arts.
We reserve the right to refuse admission or remove any person whose conduct is deemed inappropriate or
disruptive.
7. Personal Data
By purchasing a ticket or audition pass, you consent to the collection and use of your personal data for the
purposes of event management and communication in accordance with our Privacy Policy.
8. Health and Safety Compliance
Attendees must comply with all health and safety guidelines and protocols in place at the time and place of the
event or audition.
9. Limitation of Liability
BD Performing Arts shall not be liable for any loss, injury, or damage to any person or property in connection
with the event or audition to the fullest extent permitted by law. You voluntarily assume all risks and danger
incidental to the event for which the ticket is issued, whether occurring before, during, or after the event,
and you waive any claims for personal injury or death against us, management, facilities, leagues, artists,
other participants, and all of our respective parents, affiliated entities, agents, officers, directors, owners,
and employees on behalf of yourself and any accompanying minor.
10. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the State of
California and may not be modified except in writing when signed by all parties. The Parties agree the courts’
location in Contra Costa County shall have exclusive jurisdiction and venue over any claim arising under this
Agreement.
11. Payment Methods
All ticket prices are stated in U.S. dollars. We accept several payment methods to accommodate your needs,
including American Express, Visa, MasterCard, and Discover. Tickets purchased on our Site and at on-site Box
Offices are subject to a per-ticket, non-refundable handling and processing fee.
12. Weather
In the event of inclement weather, some shows may be delayed until the weather has passed or may be altered in
anticipation of incoming weather. All weather-related decisions will be made at the stadium at the time of the
event. BD Performing Arts, USBands, and the local event operators will do all that they can to have a
performance on the field while keeping performer and fan safety the main priority. If a performance does get cut
short or canceled, no refunds or rain checks will be issued. While BD Performing Arts and USBands regrets the
inconvenience caused by weather and potential changes in location, BD Performing Arts and USBands cannot be held
responsible for any cost or damage incurred by the customer resulting from postponement or cancellation of any
event.
13. Chargebacks and Other Refund Prohibitions
You agree that you will not attempt to evade, avoid, or circumvent any refund prohibitions in any manner with
regard to the tickets you purchased. You will not dispute or otherwise seek a “chargeback” from the company
whose credit card or payment method you used to purchase tickets from the Site. Should you do so, your tickets
are subject to immediate cancellation. We may, in our sole discretion, refuse to honor pending and future ticket
purchases made from all credit card accounts on which such chargebacks have been made and may prohibit future
purchases from all persons in whose name the credit card accounts exist and from any person who accesses any
associated online account or credit card or who otherwise breaches this provision from using the Site.
14. Use of Audio or Video Recording Devices
The use of audio or video recording devices is strictly prohibited.
15. Recording, Transmission, and Exhibition
You agree that the event for which you purchase tickets is a public event, that your appearance and actions
inside and outside the venue where the event occurs are public in nature, and that you have no expectation of
privacy with regard to your actions or conduct at the event. You grant permission to us, the Event Organizer(s),
our partners, licensees, and assigns, including but not limited to our brand and media partners, to utilize your
name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio,
video, or photographic display or other transmission, exhibition, publication, or reproduction made of, or at,
the event (regardless of whether before, during, or after performance) for any purpose, in any manner, in any
medium or context now known or hereafter developed, without further authorization from, or compensation to, you
or anyone acting on your behalf.
16. Virtual Events
In the case of virtual events, you may view the virtual event solely for your own personal purpose. You may not
record, copy, publicly exhibit, transmit, or distribute any virtual event through any means, resell views of any
virtual event, or allow others to log into your account for the purpose of watching a virtual event.
17. Start Date/Time and Lineup Schedule Subject to Change
Event date and time are subject to change.
18. License, Ejection, and Cancellation; No Redemption Value
You agree to comply with all of the Event Organizer’s applicable rules, policies, terms, and conditions (“Event
Organizer Rules”). The Event Organizer reserves the right, without refund of any amount paid, to refuse
admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive
language, or who fails to comply with Event Organizer Rules. Breach of terms or rules will terminate your
license to attend the event without a refund. A ticket is a revocable license, and admission may be refused. A
ticket is not redeemable for cash.
19. Subject to Search
You and your belongings may be searched on entry to the event. You agree to such searches and waive any related
claims that may arise. You may be denied entry to the event without a refund or other compensation if you do not
consent to such searches. Under certain facility rules, certain items may not be brought into the premises,
including without limitation: cameras, recording devices, outside food & drinks, coolers, purses/backpacks of a
certain size, large signs, firearms, alcohol, drugs, controlled substances, laser pointers, strobe lights,
irritants (e.g., artificial noisemakers), bundles, and containers. Some venues may enforce a clear bag policy.
20. Miscellaneous
The consumption and/or possession of illegal narcotics and/or intoxicating beverages at this event is strictly
prohibited. Violators will be ejected without a refund. Tickets obtained from sources other than USBands may be
lost, stolen, or counterfeit and will not be honored in such cases. Any person buying tickets from other sources
does so at his/her own risk. Individuals aged 18 and older must have a ticket. Children aged 17 and under are
admitted free of charge. Unless specifically authorized in advance by BD Performing Arts or USBands, tickets may
not be offered as a prize in a sweepstake or contest. Pass-outs, scan-outs, or re-entry are prohibited where
required.
21. Minors and Parental Consent
Tickets and audition passes are available to individuals under the age of 18, provided that a parent or legal guardian gives consent. By purchasing a ticket or registering for an audition for a minor, the parent or legal guardian agrees to these terms and conditions on behalf of the minor. Additionally, BD Performing Arts requires that the contact information (phone number and email) of the parent or legal guardian be provided during the purchase or registration process. This information will be used to communicate important event-related details, including in the case of an emergency.
22. Emergency Medical Situations
In the case of a medical emergency, attendees should immediately notify event staff or venue personnel. If an ambulance or emergency medical services are required, BD Performing Arts and venue staff will make every effort to ensure that appropriate medical care is provided. However, BD Performing Arts is not responsible for any costs associated with medical treatment, including ambulance services. Attendees, or their parent or legal guardian in the case of minors, are advised to carry appropriate health insurance to cover such costs. For minors, every effort will be made to contact the parent or legal guardian using the provided contact information in the event of a medical emergency.
23. Parental Responsibility for Minor Attendees
Parents or legal guardians are responsible for the actions and behavior of their minor children during the event or audition. BD Performing Arts reserves the right to refuse admission or remove any minor whose conduct is deemed inappropriate or disruptive, in accordance with these terms and conditions. If a minor is removed from an event or audition for any reason, BD Performing Arts will attempt to contact the parent or legal guardian immediately using the contact information provided.
